Privacy Policy

Azul CR (“Azul”, “we”) operates azul.cr, the business directory and marketplace platform for Costa Rica, the Totally Smoked smokehouse ordering service, and the Azul WhatsApp AI assistant. Azul CR is operated by 3-102-968614 SOCIEDAD DE RESPONSABILIDAD LIMITADA, a company registered in Costa Rica. This policy explains what personal data we collect, why, how it is protected, and the choices you have. It applies to the website azul.cr, our WhatsApp business numbers, and email we send on behalf of Azul CR and Totally Smoked Costa Rica.

WhatsApp conversations. When you message an Azul or Totally Smoked WhatsApp number we receive your WhatsApp phone number, your profile name as shared by WhatsApp, and the content of your messages. Conversations with the Azul AI assistant are processed by automated systems — including artificial intelligence — to understand your request and reply.

Orders. When you place a Totally Smoked order we store the items and quantities ordered, your name if you provide it, your contact details (email and/or WhatsApp number), and the order status. Orders are fulfilled in person or by delivery arranged directly with you; we do not collect card numbers on azul.cr.

Email. If you place an order or contact us by email, we keep your email address and correspondence so we can confirm your order and answer you.

Business listings. If you list a business on Azul, we process the information you submit for the listing (business name, contact details, images, description) plus basic admin account credentials.

Technical data. Like most websites we keep server logs (IP address, browser type, pages visited) for security and performance.

We use personal data to: fulfil and confirm Totally Smoked orders; reply to your WhatsApp and email messages (including through the automated Azul AI assistant); operate the Totally Smoked email list, which you can leave at any time; publish and manage business listings you submit; keep the platform secure; and comply with legal obligations. We analyze aggregate order and message patterns to improve menus, stock, and answers, but we do not sell your personal data, and we do not use it for third-party advertising.

Messages you send to Azul’s WhatsApp numbers are delivered to us through the Meta WhatsApp Business Platform (Cloud API) and may be answered automatically by the Azul AI assistant, which generates replies using your message and information from our platform (menus, listings, events, hours). Automated replies are clearly part of the service you requested by writing to us; you can always ask to speak with a person, and Azul’s team can review conversations to help you. Administrators of the platform can also manage parts of the service (such as the Totally Smoked menu) by messaging the business number from authorized phone numbers. Do not send sensitive information (ID numbers, card numbers, health data) over WhatsApp.

We share personal data only with the providers that operate the platform, under contract and only as needed: Meta Platforms (WhatsApp Business Platform — message delivery); Resend (transactional and marketing email delivery); Vercel (website hosting); Neon(database hosting); and Z.ai (AI language-model processing that powers the Azul assistant). We may also disclose data to authorities where required by Costa Rican law, and to a buyer or successor in the event of a merger or sale of the business (under the same protections). Everything else stays internal — we never sell or rent your personal information.

Totally Smoked order customers may receive order confirmations and occasional messages about weekly menu drops and specials. Every marketing email contains an unsubscribe link, and you can also opt out by replying STOP to any message or emailing [email protected]. Opting out of marketing never removes service messages you need (like a receipt for an order you placed).

We keep personal data only as long as needed for the purposes above: order records for accounting and warranty purposes; conversation and email history while your account or subscription is active and for a reasonable period afterwards; server logs for up to 12 months. Data is stored on access-controlled infrastructure, transmitted over HTTPS, and database access is restricted to Azul operators. No internet service is perfectly secure, but we work continuously to protect your information and will notify you of any serious breach as required by law.

You may ask us to access, correct, export, or delete your personal data, or ask any question about this policy, by emailing [email protected] (Totally Smoked customers can use [email protected]) or messaging our WhatsApp. We respond to verified requests within a reasonable time. Costa Rican residents may also have rights under Ley 8968 (Protección de los Datos Personales) and can contact the Agencia de Protección de Datos de los Habitantes.

Cookies. azul.cr uses only functional storage needed for the site to work (language preference, cart, admin sessions). We do not run third-party advertising trackers. Children. The platform is not directed to children under 13, and we do not knowingly collect their data. Changes. If we change this policy we will update the date above and, for significant changes, announce it on the site or by message.
